These terms are the agreement between you and Fernando Zamora Díez for your use of Niar. By using the app you accept them. If you do not agree with them, do not use it.
Niar is a public chat based on geographic proximity. The messages you write are visible to anyone within your zone, an area of roughly 485 metres in radius. It is not a private messaging service and there is no end-to-end encryption: everything you write is public within your zone.
When you open the app an anonymous account with a randomly generated nickname is created for you. You do not need to register or provide personal data. You are responsible for the activity carried out from your device.
You can delete your account at any time from Settings → Account. Deletion is immediate and irreversible, and removes your profile, your messages and any background images you uploaded.
You must be at least 18 years old, or the age of majority in your country, to use Niar. Under no circumstances may it be used by anyone under 14. The app contains an open chat with strangers and user-generated content that may be inappropriate for minors.
There is no tolerance for objectionable content or abusive users. By using Niar you agree not to post objectionable content, and you agree that any user posting such content will be removed from the service without prior notice.
We review every report in under 24 hours and remove infringing content.

We review reports in under 24 hours. When we find a violation we may, at our discretion and without prior notice: remove the content, suspend or delete the responsible account and, where appropriate, report the matter to the authorities. There is no right to a refund for purchases made by an account removed for breaching these rules.
If you believe we acted in error, write to us and we will review it.
What you post remains yours. By posting it you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display it within Niar, for the sole purpose of providing the service. That licence ends when the content is deleted, except for copies we must retain for moderation purposes or by legal obligation.
You warrant that you hold the necessary rights over what you post and that it does not infringe third-party rights.
We do not review content before it is published. Messages and images are the sole responsibility of whoever posts them, not ours.
Each zone can have a background image shared by everyone in it. It works like this:
Changing a zone's background may have a cost. The first background in each zone is free; later changes have a rising price that resets periodically. The exact price is always shown to you before you pay.
Niar is provided "as is" and without any guarantee of continuous availability. We may modify, suspend or discontinue the service, in whole or in part, at any time. If the discontinuation is permanent we will give reasonable notice wherever possible.
Bear in mind that Niar's content is ephemeral by design: messages are deleted automatically as new ones arrive in the same zone. It is not an archival service and we do not guarantee that anything you post will be preserved.
To the fullest extent permitted by law, we are not liable for content posted by other users, for the interactions you have with them, or for damages arising from use of the service in breach of these terms.
Nothing in these terms limits the rights granted to you by consumer protection law, nor our liability for wilful misconduct or gross negligence.
A practical warning: Niar puts you in touch with strangers who are physically close to you. Apply the same judgement you would on the street. Do not share personal details, do not reveal where you live or work, and think twice before meeting someone you have met through the app.
These terms are governed by Spanish law. If you are a consumer, you may bring proceedings before the courts of your domicile and you retain all rights granted to you by the law of your country of residence in the European Union.
If any clause is found to be void, the remainder shall continue in full force.
